Terms and Conditions
These Terms & Conditions apply to all equipment, marquees, furnishings, and hire items supplied by Limestone Coast Party Hire (“the Owner”). By submitting an order, paying a deposit, or confirming a booking, the customer (“the Hirer”) agrees to the following terms.
Definitions
- LCPH: Limestone Coast Party Hire.
- Owner: The company supplying the equipment to the Hirer: White Radford White Pty Ltd trading as Limestone Coast Party Hire (ABN 92 695 054 721).
- Hirer: The person or organisation hiring the equipment from the Owner.
- Equipment: All items which the Owner agrees to supply to the Hirer.
- Site: The location where delivery or installation is scheduled to take place.
- Hire Period: The agreed timeframe of the hire as specified on the quote or invoice.
- Order: The equipment requested by the Hirer as reflected on the quote or invoice.
- Invoice: The tax invoice supplied via email.
- Booking: The confirmation issued to the Hirer once the Owner has accepted the order.
- Price: The total hire charge for equipment and services as shown on the quote or invoice.
Important Notes

- Marquee & Light Pricing: Prices include installation and dismantling.
- Set-Up Packages: A styling and set-up package must be selected and paid for by the customer for the placement of furniture or styling items within marquees or venues.
- Delivery: Prices do not include delivery unless specifically stated.
- Surcharges: Additional fees apply for Sundays, Public Holidays and difficult locations
- Responsibility: The Hirer is responsible for any loss or damage to equipment during the hire period.
- Prohibited Items: Include open flame candles, crepe paper, streamers, balloons, adhesives, pins, staples, or tapes are to be used inside or on marquees. These cause permanent staining or damage, incurring full replacement costs.
1. The Hire
1.1 Quote: The Hirer may receive a digital quote which is valid for 30 days or until a deposit or full payment amount is received.
1.2 Hiring: The Hirer hires the equipment from the Owner for the agreed Hire Period and Price as shown on the quote or invoice.
1.3 Ordering and Acceptance: The Hirer may request to hire equipment by submitting an Order. The Owner accepts the Order by communicating acceptance and providing an Invoice for a 30% deposit or full payment. The order is booked once payment is received.
1.4 Prices: Published prices are for the Hire Period and do not include delivery, pick-up, site preparation, or collecting unless stated. Price lists are subject to change without notice. All Prices are EX GST.
2. Payments and Additional Costs
2.1 Deposit: A non-refundable deposit of 30% must be paid within 14 days of receiving the invoice to secure the equipment for the requested date.
2.2 Balance: The remaining balance must be paid 30 days prior to the agreed hire dates. Last-minute additions are payable prior to delivery or collection.
2.3 Non-Payment: If full payment is not cleared prior to scheduled delivery, the Owner may withhold delivery, and additional costs may be incurred for rescheduling.
2.4 Payment Methods: Payments can be made via bank transfer, credit card (online link), or cash. Cheques are not accepted.
2.5 Major Event Bookings: Bookings where the Hire price exceeds five thousand ($5000) AUD will incur further payment requirements, as follows:
- Standard 30% non refundable deposit.
- 50% of the Hire price must be paid one hundred & eighty (180) days prior to the Hire Period.
- 75% of the Hire price must be paid ninety (90) days prior to the Hire Period.
- 100% of the Hire price must be paid thirty (30) days prior to the Hire Period.
- Any last minute adjustments are to be made before delivery.
- The Owner may, at their absolute discretion, allow the Hirer to adjust this schedule or postpone payment beyond the Hire Period. Overdue Invoices beyond the hire period will incur a 10% late fee per week.
2.6 Additional Charges: At the Owner’s discretion, extra charges may apply for:
- After-hours, weekend, or public holiday delivery/collection.
- Delays caused by the Hirer or inaccessible, unsafe, or unlevel sites.
- Excessive cleaning or call-outs during the event.
- Replacement of damaged/missing items or incorrect packaging upon return.
- Delivery to difficult or non-standard locations.
3. Hire Period
3.1 Hire Period: The standard Hire Period is 3 days, inclusive of delivery and collection days, unless otherwise agreed.
3.2 Late Returns: Failure to return equipment by the agreed time will incur additional charges based on daily hire rates.
3.3 Early Returns: No refunds are provided for early returns or unused items.
4. Responsibility and Equipment Care
4.1 General Responsibility: The Hirer is responsible for all loss, damage, theft, or breakage from the time of delivery until collection (or pick-up until return).
4.2 Protection: The Hirer must protect equipment from wind, rain, misuse, vandalism, fire, or accidental damage.
4.3 Prohibited Items: Include open flame candles, crepe paper, streamers, balloons, adhesives, pins, staples, or tapes are to be used inside or on marquees. These cause permanent staining or damage, incurring full replacement costs.
4.4 Cooking: Cooking or grilling under marquees is prohibited without prior approval.
4.5 Cleanliness: All equipment must be returned clean, dry, and in the condition provided; otherwise, cleaning fees will apply.
4.6 Transport: Equipment must be collected in an appropriate vehicle/trailer. Unsuitable transport may lead to cancellation and forfeiture of payments.
4.7 Damage Notification: LCPH must be notified immediately if equipment becomes unsafe or damaged. All damaged items must still be returned to avoid being charged at full replacement cost.
5. Installation and Site Conditions
5.1 Access: The Hirer must ensure the site is clear, level, accessible, and safe.
5.2 Underground Services: The Owner accepts no responsibility for damage to underground services unless an official site plan is provided prior to setup.
5.3 Third-Party Equipment: LCPH does not set up competitors’ marquees.
6. Safety, Liability, and Disclaimer
6.1 Suitability: It is the Hirer’s responsibility to ensure the equipment meets their requirements; it is supplied without guarantee of suitability for a specific purpose.
6.2 Safety: The Hirer accepts full responsibility for their safety and the safety of their guests.
6.3 Indemnity: The Hirer releases and indemnifies the Owner against all third-party claims, costs, and expenses for damage, injury, or death arising from the hire or use of the equipment.
6.4 Insurance: The Hirer must hold their own Public Liability Insurance for the duration of the hire.
6.5 Repairs: The Hirer must not attempt to repair equipment without explicit approval from the Owner.
7. Weather Conditions
7.1 Monitoring: Marquees are temporary structures. The Hirer is responsible for monitoring weather conditions to protect guests and equipment.
7.2 Evacuation: In severe weather, occupants must evacuate. Umbrellas and marquees must be closed in windy conditions.
7.3 Owner Rights: LCPH reserves the right to refuse installation or dismantle early if conditions are unsafe.
8. Collection and Return
8.1 Attendance: The Hirer or a representative must be present for both delivery and pick-up.
8.2 Readiness: Items (excluding marquees) must be packed and ready for collection at the agreed time.
8.3 Theft: Equipment unreturned after 7 days may be reported to the police as theft.
9. Cancellations
9.1 Cancellation Notice: The Hirer has the right to cancel a Booking upon providing notice to LCPH. The Cancellation Notice must be provided to LCPH as soon as practicably possible and must be in writing.
9.2 Cancelled Bookings: Upon receipt of a cancellation notification, LCPH has no further obligation to supply or deliver the Equipment to the Hirer.
9.3 Cancellation Fees: Cancellation fees may be charged by LCPH where Equipment has been reserved and the Hirer cancels the booking without reasonable notice, as following:
- Deposit of 30% of the Hire price will be forfeited for all cancellations.
- A Cancellation fee of 50% of the Hire price will apply to all cancellations within thirty (30) days prior to the Hire Period.
- 100% of the Hire price will apply to all cancellations within seven (7) days prior to the Hire Period.
- LCPH may, in its absolute discretion, allow any Cancellation Fees to be used as credits for redemption on future bookings. (including, for example, postponements due to government restrictions or extreme weather conditions).
